Cancellation, Return/Withdrawal Policy – Galerie Lefakis
Thank you for your purchase from Galerie Lefakis. In case you change your mind or are not satisfied with your order, you have the option to return the product within 14 days from receipt, according to the terms set out below.
Right of Withdrawal
The buyer has the right to withdraw from the purchase of the product within 14 calendar days from its receipt, without any reason whatsoever. The withdrawal must be made in writing or by telephone through:

In this case, the Company is obliged to refund the purchase amount within 14 days from receipt of the withdrawal statement, to the bank account you will indicate during your communication.
Return Procedure
Product Return: The product must be returned in its original packaging, without damages or alterations, and with all accompanying documents (e.g. Retail Receipt, DAT, Certificate of Authenticity, etc.).
Return to Store or via Courier:
You can return the product in person to our store, Galerie Lefakis (Kolonaki, Tsakalof 15, 10673), or
Send it via Courier to the above address.
In any case, return costs are borne by the customer, unless the return is due to the Company's fault (e.g. wrong shipment or defective product).
Return Terms: For the return to be accepted, the product must be unused, in the same condition as you received it and without having suffered any damage or wear.
Refund or Replacement
The refund will be made using the same payment method you used during purchase. If you wish, we can credit your account for a future purchase.
In case of return of a discounted or promotional product, the return is made at the price that was valid on the day of order receipt, provided it is made within 14 days from receipt.
Exceptions from the Right of Withdrawal
The Company does not accept returns for artworks that have undergone any modification or customization following the customer's order. Also, returns of products that are on sale or special offer will be accepted only within the stipulated period of 14 days from receipt.
Returns of Defective Products
In case the artwork arrives to you damaged or defective, please inform Galerie Lefakis as soon as possible, and no later than 8 hours from receipt, by phone at +30 210 6899049 or by email at info@galerielefakis.com. Please also send a photo of the defective product so we can take responsibility and proceed with the return process.
Important: The return of the defective product will be accepted only if the product is returned in its original packaging and with all accompanying documents (e.g. Purchase Receipt).
The cost of return for defective products is borne by the Company.
GENERAL TERMS AND CONDITIONS OF PARTICIPATION
Online Auction – Galerie Lefakis
By participating in the online auction organized by Galerie Lefakis, all bidders acknowledge that they have read, understood, and fully accepted these Terms and Conditions without reservation.
1. Auctioneer
Galerie Lefakis acts either as the owner of the auctioned items or as an agent representing the consignor (seller), mediating the sale between the seller and the buyer (highest bidder).
2. Auction Items
Galerie Lefakis, in good faith, assumes that all auctioned items are free of any encumbrances, third-party claims, legal or physical defects.
3. Inspection of Auction Items
All items are displayed on Galerie Lefakis' website before the auction. Prospective buyers must inspect the works prior to bidding. Upon written request, a Condition Report is available. Additionally, bidders may view the works at Galerie Lefakis' physical gallery. By placing a bid, the bidder acknowledges satisfaction with the item's condition.
4. Currency and Payment
All transactions are conducted in Euros (€). Payment can be made via bank transfer, cash, or debit/credit card. Payments in other currencies are accepted based on the official exchange rate on the sale date.
5. Registration
Bidders must register prior to the auction, submitting a valid form of identification. Bidders acting on behalf of another party must declare the principal's details in advance.
6. Starting Price and Value
The starting prices are determined by Galerie Lefakis or the consignor and represent the minimum sale price. Bids below the starting price will not be accepted. The starting price is not a guarantee of the final hammer price.
7. Auctioneer's Discretion
Galerie Lefakis reserves the right to determine bidding increments, reject bids, withdraw items from the auction, or deny participation at its sole discretion.
8. Irrevocability of Bids
Once submitted, bids cannot be cancelled or reduced during the live online auction. All registered bids are binding and alter the current bid accordingly.
9. Hammer Price and Contract Formation
The successful bidder is the one who places the highest bid at the close of the auction ("hammer fall"). A legally binding sale contract is formed between the buyer and the seller at that point.
10. Purchase Price Components
The final purchase price consists of:
The hammer price
Shipping costs (where applicable), based on destination, size, and weight
VAT (24%) on applicable fees
Artist's Resale Right (Droit de Suite), where applicable, based on Law 2121/1993:
5% up to €50,000
3% from €50,000.01–€200,000
1% from €200,000.01–€350,000
0.5% from €350,000.01–€500,000
0.25% beyond €500,000
The maximum droit de suite fee is capped at €12,500. VAT (24%) also applies to this fee and is payable by the buyer.
11. Delivery of Lots
Items are delivered only after full payment is received. Galerie Lefakis is not liable for damage caused during shipping. Buyers may request insurance for shipment at their own expense, and Galerie Lefakis can recommend appropriate handling agencies.
12. Payment Obligation
The buyer is responsible for the timely settlement of the invoice issued for the auctioned item.
13. Collection Period
If the item is not collected within 10 calendar days of payment, storage fees apply, and the buyer assumes the risk of damage.
14. Default
If the buyer fails to pay or refuses to collect within 10 days of the auction date, Galerie Lefakis may:
Pursue legal action to recover the amount due with interest and costs
Set a final 5-day grace period for payment, after which the sale is cancelled
In such cases, the lot may be resold privately or publicly. If the resale price is lower than the original hammer price, the original buyer is liable for the difference and may also face claims for further damages.
15. Return Policy – Authenticity
The buyer may return a purchased item within two years from the auction date only if it is proven beyond dispute (with two independent written expert opinions acceptable to both parties) that the item is not authentic.
Conditions:
The item must not have been resold or transferred
It must be in the same condition as at the time of sale
If authenticity was disputed in the catalog, return rights are void
If the work has not yet been paid out to the seller, the full price is refunded. If already paid, the buyer may recover the hammer price directly from the seller. Galerie Lefakis will refund only its commission, without interest. In such cases, the auction house is obligated to disclose the consignor's identity and contact details to the buyer.
The buyer explicitly waives any other claims against Galerie Lefakis. All return-related expenses are borne by the buyer.
